§ 1. General Information

This Privacy Policy defines the rules for collecting, processing, and using personal data obtained by the MotoHarley.pl Online Store (hereinafter referred to as the "Store").

MotoHarley.pl takes special care to respect the privacy of Customers visiting the Online Store.
§ 2. How do we collect data?

MotoHarley.pl collects information regarding natural persons conducting business or professional activities on their own behalf (hereinafter referred to as Entrepreneurs), as well as data of individuals performing legal acts not directly related to their business, collectively referred to as Customers.

Personal data of Customers are collected when registering a Customer in the Store by creating a Customer Account, when Customers make a one-time purchase without the need to create an Account in the Store, and on our auctions on Allegro.pl; OLX.

In the case of registering an Account in the Store, the Customer sets their access password and provides the following data:
- First and last name;
- Email address;
- Address (street, house/apartment number, postal code, city, and country);
- Phone number;
- For Entrepreneurs, the above data scope is additionally expanded to include the Entrepreneur's company name and tax identification number (NIP).

The above data can be changed independently by the Customer after logging into the Customer Account.

When placing a one-time order in the Online Store, the scope of data required to be provided by Customers is identical. Customers provide the following data:
- First and last name;
- Email address;
- Address (street, house/apartment number, postal code, city, and country);
- Phone number;
- For Entrepreneurs, the above data scope is additionally expanded to include the Entrepreneur's company name and tax identification number (NIP).

Additional information is automatically collected during the use of the Store's websites (IP address assigned to your computer or external IP address of the Internet provider, domain name, browser type, access time, operating system type).

Navigation data, including information about links and references chosen to click or other actions taken in our Online Store, may also be collected from Customers.
§ 3. How do we use the collected data?

In the case of registering a Customer Account in the Store or making a one-time purchase, Customer data is used for: creating an individual Customer Account and managing this account, ensuring the ability to make purchases in the Store, including fulfilling placed orders and their delivery. Resolving technical issues; handling inquiries and reports addressed to us (e.g., via the contact form); contacting you, including for purposes related to service provision.

In the case of purchasing in the Store, personal data may be transferred to Entities such as:
- Courier company;
- Supporting us in providing electronic services, i.e., those that provide payment services.

In the case where a Customer chooses payment via dotpay.pl, their personal data is transferred to Dotpay Sp. z o.o. to the extent necessary for payment processing, based in Kraków, 30-552 Kraków, ul. Wielicka 72, registered by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division of the National Court Register under number 0000700791, with tax identification number (NIP) 634-26-61-860, EU VAT number PL6342661860, and REGON number 240770255.

Navigation data may be used to provide better service to Customers, analyze statistical data, tailor the Online Store to Customer preferences, and administer the Online Store.

Additionally, legal regulations require us to process your data for tax and accounting purposes.

We also process your personal data for the following purposes, based on the legitimate interest of MotoHarley.pl, which includes:
- Monitoring your activity, including searching for keywords and managing your activity on MotoHarley.pl;
- Adjusting ads based on previously viewed content by you, adjusting categories of offers or individual offers based on your activity on MotoHarley.pl;
- Conducting direct marketing towards you;
- Contacting you, including for purposes related to permitted marketing activities, through available communication channels, especially and with your consent – via email and telephone;
- Conducting statistical analysis;
- Storing data for archival purposes and ensuring accountability (demonstrating our compliance with legal obligations).
If you agree, we process your personal data for:
- Storing data in cookies files, collecting data from websites and mobile applications;
- Organizing contests and promotional campaigns in which you can participate.
§ 4. Access to data

Your data may also be disclosed to entities authorized to receive it under applicable law, in particular to the competent authorities of justice and entities indicated in the point "How do we use the collected data?"

MotoHarley.pl provides Customers who have a Customer Account with uninterrupted access to their data and the possibility of modifying it at any time. To make changes, please log into your Customer Account in the Store. The Customer has the option to delete personal data from the data set in case of termination of the agreement for the provision of electronic services, submitted through the notification form. MotoHarley.pl may refuse to delete Customer data if the Customer has violated the applicable Store Regulations, and the retention of data is necessary to clarify these circumstances and establish liability, especially to pursue claims against the Customer.
§ 5. What are your rights regarding MotoHarley.pl in relation to processed data?

We guarantee compliance with all your rights under the General Data Protection Regulation, i.e., the right to access, rectify, or delete your data, limit its processing, the right to data portability, not to be subject to automated decision-making, including profiling, and the right to object to the processing of your personal data.

You can exercise these rights when:
- Regarding the request to correct data: you notice that your data is incorrect or incomplete;
- Regarding the request to delete data: your data is no longer necessary for the purposes for which it was collected by MotoHarley.pl; you withdraw your consent to data processing; you object to the processing of your data; your data is processed unlawfully; the data should be deleted to comply with a legal obligation or the data was collected in connection with the provision of electronic services offered to a child;
- Regarding the request to restrict data processing: you notice that your data is incorrect – you may request the restriction of processing your data for a period allowing us to verify the accuracy of this data; your data is processed unlawfully, but you do not want it to be deleted; your data is no longer needed by us, but you may need it for defense or to assert claims; or you raise an objection to the processing of data – until it is determined whether our legally justified grounds outweigh the grounds for objection;
- Regarding the request for data portability: the processing of your data is based on your consent or a contract concluded with you, and when this processing is carried out automatically;
- Regarding the objection to the processing of your personal data: the processing of your personal data is based on a legitimate interest or for statistical purposes, and the objection is justified by a specific situation in which you have found yourself, your personal data are processed for direct marketing purposes, including profiling for this purpose.

You have the right to lodge a complaint regarding the processing of your personal data to the competent data protection authority.
§ 6. How long do we store your personal data?

We store your personal data for the duration of the agreement concluded with you, as well as after its termination for purposes:
- Asserting claims related to the performance of the agreement;
- Fulfilling obligations arising from legal regulations, including in particular tax and accounting regulations;
- Preventing fraud and abuse;
- Statistical and archival purposes.

We store your personal data for marketing purposes for the duration of the agreement or until you object to such processing, depending on which of these events occurs earlier.

In the case of organizing loyalty programs, contests, and promotional campaigns in which you can participate – we will process your data for the duration of their duration and the settlement period for awarding prizes. For accountability purposes, i.e., to demonstrate compliance with the provisions concerning the processing of personal data, we will store data for the period in which MotoHarley.pl is obliged to keep data or documents containing them to document compliance with legal requirements and enable control of their compliance by public authorities.
§ 7. Do we transfer your data to countries outside the European Economic Area?
We do not transfer your personal data outside the European Economic Area.
§ 8. Security

MotoHarley.pl applies safeguards to protect data against loss, misuse, and alteration. MotoHarley.pl undertakes to protect all your data in accordance with security protection standards and confidentiality.

Personal data in MotoHarley.pl is protected in accordance with the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 2015, item 2135, as amended), in a way that prevents access to them by third parties.

In the event that a Customer with an account in the Store loses their access password in any way, the Online Store allows for the generation of a new password for the account. However, the Online Store does not send password reminders. The Customer's password is stored in the database in an encrypted form that prevents its reading.
